The Supreme Court on Friday dismissed a plea of its Emerald Court project in Noida, adjoining Delhi, seeking more time for demolition of the twin towers and payment of compensation to flat buyers.
The Supreme Court on Friday dismissed a fresh petition by Supertech Ltd, seeking more time for demolition of the twin towers of its Emerald Court project in Noida and payment of compensation to flat buyers. The top court said that in view of its decision, the fresh petition cannot be entertained.
Justice DY Chandrachud and Justice B.V. The bench of Nagarathna said that after the pronouncement of the verdict, it cannot hear various applications or give any extension of time. “You have to pay them,” the bench said.
Senior advocate Parag Tripathi, appearing for Supertech Ltd, submitted that he was also not satisfied with the manner in which the petition was framed and sought hearing of the matter after Diwali holidays. He said they needed some time to implement the court’s direction for demolition of towers and payment of compensation to flat buyers. To this, the bench said that the company will have to pay the amount mentioned in the order. Thereafter the bench dismissed the petition.
In an earlier hearing, the Supreme Court had said that Supertech’s two 40-storey towers containing 915 flats and shops were constructed in connivance with the Noida Authority. The bench had said that the two towers should be demolished within three months under the supervision of the Noida Authority and expert agency and the entire cost would be borne by Supertech Ltd.
In its order, the Supreme Court had also said that the entire money of home buyers should be returned with 12 percent interest from the time of booking. Along with this, two crore rupees should be paid to the Residents Welfare Association for the trouble caused by the construction of two towers.
